This IP Policy outlines the measures we take to prevent and address IP infringements, including the sale of counterfeit goods and unauthorized use of trademarks, copyrights, and other protected content.

Prohibited Activities

Sellers on Topball.net are prohibited from listing or selling counterfeit goods, infringing copyrighted material, unauthorized trademarked products, or any other goods that violate IP laws. We require all sellers to ensure the authenticity and legality of the items they list on our platform.

Counter-Notification Process for Sellers

If you believe a report of IP infringement is incorrect or that you are legally entitled to use the content in question, you may submit a counter-notification. Your counter-notification should include:

  1. Your Contact Information: Full name, mailing address, phone number, and email address.
  2. Identification of the Removed Content: A description of the content that has been removed and its location before removal (e.g., specific URLs).
  3. Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief the content was removed as a result of a mistake or misidentification.
  4. Consent to Jurisdiction: A statement agreeing to the jurisdiction of the federal court located in your area, or if outside the U.S., to an appropriate jurisdiction, for any judicial proceedings.

Please send your counter-notification to support@topball.net. Upon receiving a valid counter-notification, we will reinstate the content unless the rights holder initiates a lawsuit within 10 business days.

Enforcement and Consequences of IP Violations

Topball.net reserves the right to take any of the following actions in response to verified IP violations:

  • Remove Infringing Listings: Infringing listings may be removed without notice.
  • Suspend or Terminate Accounts: Repeated or severe violations may result in account suspension or termination.
  • Legal Reporting: We may report IP violations to legal authorities if we believe it is necessary or required by law.

Repeat Infringer Policy

Topball.net may terminate the accounts of sellers who are found to repeatedly infringe IP rights. Sellers are responsible for ensuring compliance with all applicable IP laws and may be permanently banned for violations.
